Micromate Approved for Compliance with New NYC DEP Construction Noise and Vibration Monitoring Requirements
The New York City Department of Environmental Protection (DEP) has adopted a significant amendment to its Citywide Construction Noise Mitigation Rules, requiring noise monitoring at certain construction sites conducting after-hours work.
The new rule, which took effect on April 21, 2026, represents one of the most notable changes to New York City's construction noise regulations in recent years. The requirement is intended to provide greater transparency, improve compliance with approved noise mitigation plans, and help address community concerns regarding nighttime construction activity.
The Micromate monitoring system is already certified by the New York City Department of Environmental Protection (DEP)for use under the City's construction noise monitoring requirements.
What Is Changing?
The amendment adds a new requirement to Chapter 28 of Title 15 of the Rules of the City of New York (RCNY), requiring qualifying construction projects to deploy noise monitoring equipment when operating outside normal construction hours.
The rule applies to projects that:
Require an Alternative Noise Mitigation Plan (ANMP) for after-hours work;
Will conduct after-hours construction activities for 30 days or longer;
Have a gross floor area of 200,000 square feet or more; and
Are located within 50 feet of a residential receptor.
Projects meeting all of these criteria will be required to install and maintain noise monitoring equipment as part of their approved after-hours construction operations.
Why Is NYC Requiring Noise Monitoring?
Construction activity is often necessary during evenings, nights, and weekends to minimize impacts on traffic, transit systems, utilities, and critical infrastructure. However, these activities can create significant noise concerns for nearby residents.
By requiring continuous noise monitoring, DEP aims to:
Improve accountability for after-hours construction projects;
Provide objective data regarding noise impacts;
Verify compliance with approved mitigation measures;
Support enforcement efforts when complaints arise; and
Encourage contractors to proactively manage noise levels.
The rule reflects a growing trend among major cities and transportation agencies to rely on real-time monitoring data rather than solely periodic inspections or complaint-based enforcement.
What Does This Mean?
Contractors performing qualifying after-hours work will need to incorporate noise monitoring into their project planning and compliance programs.
This may include:
Selecting appropriate monitoring equipment;
Identifying suitable monitoring locations;
Ensuring equipment remains operational throughout the project;
Maintaining records of monitoring data; and
Providing information requested by DEP as part of compliance verification.
For many firms, noise monitoring will become another standard component of environmental compliance, similar to dust monitoring, vibration monitoring, and air quality management.

The adoption of this rule signals a broader shift toward data-driven environmental oversight on construction projects.
