What Is Changing?

The amendment adds a new requirement to Chapter 28 of Title 15 of the Rules of the City of New York (RCNY), requiring qualifying construction projects to deploy noise monitoring equipment when operating outside normal construction hours.

The rule applies to projects that:

• Require an Alternative Noise Mitigation Plan (ANMP) for after-hours work;

• Will conduct after-hours construction activities for 30 days or longer;

• Have a gross floor area of 200,000 square feet or more; and

• Are located within 50 feet of a residential receptor.

Projects meeting all of these criteria will be required to install and maintain noise monitoring equipment as part of their approved after-hours construction operations.
